1. Who may use the site
The site is for adults. You must be at least 18 to use it, and by using it you confirm that you are.
2. What the site provides
The site offers a search of homes listed for sale in the Arizona Regional Multiple Listing Service (ARMLS), an optional Property Organizer for saving searches and favorite listings, email market reports, a Home Values feature, a contact form, and information about me and West USA Realty. All of it is provided for your personal, non-commercial use in considering a real estate purchase or sale.
3. MLS listing data
Listing information on this site comes from ARMLS and is provided through iHomefinder under an IDX (Internet Data Exchange) agreement. Listings are marked with the name of the listing brokerage. The data is deemed reliable but is not guaranteed by ARMLS, the listing brokerages, West USA Realty, or me, and it can change or go out of date at any time. You may use it only to identify properties you may be interested in buying, and you may not copy, redistribute, scrape, or use it for any other purpose. ARMLS and the listing brokerages own the listing content and reserve all rights.
4. Home value estimates
The Home Values feature is provided by Homebot and produces an automated estimate from public records and market data. An estimate is not an appraisal, not a broker price opinion, not a comparative market analysis, and not a price at which I or anyone else will list, buy, or sell a property. If you want an opinion of value for a specific home, contact me and we’ll talk about it.
5. No agency relationship
Using this site, searching listings, requesting a home value, or contacting me does not create an agency, brokerage, or client relationship. That relationship exists only when you and I sign a written agreement as Arizona law requires. Until then I owe you the honesty and fair dealing Arizona requires of every licensee, but I am not representing you.
6. Property Organizer accounts
The Property Organizer is run by iHomefinder and is subject to iHomefinder’s own terms as well as these. Keep your login private; you’re responsible for activity under it. I can close an account that is used to misuse listing data.
7. Intellectual property
The text, design, photographs, and other original content on this site are mine, © Carl Chapman, all rights reserved, except where noted. Listing content belongs to ARMLS and the listing brokerages. The West USA Realty name and logo are the brokerage’s. REALTOR® is a registered collective membership mark of the National Association of REALTORS®. You may view and print pages for personal use; any other use needs my written permission. Copyright concerns are handled under my DMCA Policy.
8. Acceptable use
Don’t use the site to do anything unlawful, to harvest or scrape data, to interfere with the site or its services, to impersonate anyone, or to send spam. I can restrict or block access to anyone who does.
9. Third-party services and links
Parts of the site are run by other companies — iHomefinder, Homebot, Google Analytics, and my hosting and consent-management providers — and the site links to outside sites such as the Arizona Department of Real Estate, West USA Realty, and MLS listing pages. Those companies and sites have their own terms and privacy policies, and I’m not responsible for them.
10. Not professional advice
Nothing on this site is legal, tax, financial, lending, inspection, or appraisal advice. Real estate decisions involve all of those; talk to the appropriate licensed professional before you act.
11. No warranties
The site and everything on it are provided “as is” and “as available.” I don’t promise that the site will be uninterrupted or error-free, or that any information on it is complete, accurate, or current. To the fullest extent Arizona law allows, I disclaim all warranties, express or implied.
12. Limitation of liability
To the fullest extent Arizona law allows, neither I nor West USA Realty will be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the site or reliance on anything on it. If we are found liable for anything connected with the site, our total liability is limited to one hundred dollars ($100).
13. Governing law
These terms are governed by the laws of the State of Arizona. Any dispute about the site will be brought in the state or federal courts located in Maricopa County, Arizona.
14. Changes
I may update these terms; the dates at the top will change when I do. Continued use of the site after a change means you accept the updated terms.
